उत्तराखंड में समान नागरिक संहिता लागू: ऐतिहासिक कदम

उत्तराखंड सोमवार से समान नागरिक संहिता (UCC) लागू करने वाला स्वतंत्र भारत का पहला राज्य बनने जा रहा है। मुख्यमंत्री पुष्कर सिंह धामी ने कहा है कि इस कानून को लागू करने के लिए सभी तैयारियां पूरी कर ली गई हैं। सरकार का दावा है कि यह कानून समाज में समानता लाने और सभी नागरिकों को समान अधिकार और जिम्मेदारियां सुनिश्चित करने के लिए लाया गया है।

Uttarakhand is set to become the first state in independent India to implement the Uniform Civil Code (UCC) starting Monday. Chief Minister Pushkar Singh Dhami announced that all preparations for the enforcement of the law have been completed. The government claims that this legislation will bring uniformity to society and ensure equal rights and responsibilities for all citizens.

चुनावी वादे से लेकर क्रियान्वयन तक

2022 के विधानसभा चुनावों में भाजपा ने वादा किया था कि उत्तराखंड में UCC लागू किया जाएगा। इन चुनावों में पार्टी ने लगातार दूसरी बार सत्ता हासिल की, जो राज्य के इतिहास में पहली बार हुआ। मुख्यमंत्री धामी ने कहा कि यह जीत UCC को लागू करने की पार्टी की प्रतिबद्धता का परिणाम है।

The BJP had promised to implement the UCC in Uttarakhand during the 2022 assembly elections. These elections saw the party securing power for a second consecutive term, an unprecedented achievement in the state’s history. Chief Minister Dhami attributed this victory to the party’s commitment to passing the UCC.

मार्च 2022 में चुनाव जीतने के बाद, राज्य कैबिनेट ने UCC पर एक विशेषज्ञ समिति बनाने का प्रस्ताव पारित किया। सुप्रीम कोर्ट की पूर्व न्यायाधीश रंजना प्रकाश देसाई की अध्यक्षता में इस समिति ने डेढ़ साल तक विभिन्न समुदायों से संवाद किया और चार खंडों में विस्तृत मसौदा तैयार किया। यह मसौदा फरवरी 2024 में राज्य सरकार को सौंपा गया। कुछ ही दिनों बाद विधानसभा ने इसे पारित कर दिया, और मार्च 2024 में राष्ट्रपति की मंजूरी प्राप्त हुई।

In March 2022, following its electoral victory, the state cabinet approved the formation of an expert panel on the UCC. Chaired by former Supreme Court judge Ranjana Prakash Desai, the committee conducted extensive consultations with various communities over 18 months and prepared a detailed draft in four volumes. This draft was submitted to the state in February 2024, followed by its passage in the assembly and presidential assent in March 2024.

क्या है उत्तराखंड की UCC?

उत्तराखंड की समान नागरिक संहिता विवाह, तलाक, उत्तराधिकार, और लिव-इन रिलेशनशिप जैसे मामलों को नियंत्रित करेगी। यह सभी धर्मों के लिए विवाह की आयु, तलाक के आधार और प्रक्रिया को एक समान बनाती है। बहुविवाह और हलाला पर प्रतिबंध लगाया गया है।

The UCC in Uttarakhand will regulate matters such as marriage, divorce, inheritance, and live-in relationships. It standardizes the age of marriage, grounds for divorce, and procedures across all religions while banning polygamy and ‘halala.’
